Professional Disciplinary Work

professional disciplinary WORK

In addition to his criminal and regulatory work, Ian also acts for professional clients in relation to professional disciplinary matters – including professional body investigations and professional disciplinary tribunal hearings, such as the Health Practitioner’s Disciplinary Tribunal and the Lawyers and Conveyancers Disciplinary Tribunal.

Ian has developed these areas of speciality to respond to the needs of his clients, some of whom have faced criminal/regulatory charges and who also faced disciplinary action from their relevant professional body.

Although these disciplinary proceedings are, in some ways, more akin to civil proceedings, there is also considerable cross-over with criminal matters, including the fact that these matters often go to hearing and require live evidence and cross-examination. Ian’s experience as a criminal litigator has him well-placed to deal with such matters.

Clients also find that it is more cost-effective to have Ian acting for them across all related matters that they have to deal with.

Examples of Ian’s work in this realm include:

  • Appearing for legal practitioner at full ‘trial’ hearing before the Lawyers and Conveyancer’s Disciplinary Tribunal in December 2022 (client’s name suppressed).
  • Acting for medical doctor in 2022 in relation to investigation carried out by the PCC on behalf of the Medical Council. That investigation related to sexual charges that Ian was already assisting the client with. That matter was resolved by agreement without the need for any hearing.
  •  Acting for pharmacist charged with criminal fraud offending in relation to investigation by the Pharmacy Board (and PCC) and subsequent (ongoing) proceedings before the Health Practitioner’s Disciplinary Tribunal.
  • Assisting clients dealing with complaints made to Institute of Professional Engineers New Zealand (IPENZ).
  • Assisting clients facing criminal charges with parallel Teaching Council of NZ conduct investigations.
